Condizioni di vendita
I rapporti commerciali fra l’impresa Bagni Claudio ed i clienti sono regolati esclusivamente dalle seguenti condizioni di vendita, a norma della vigenti leggi.
I nostri prodotti sono costruiti su specifica (su misura) del cliente che può scegliere colori, materiali,
I prodotti sono pertanto fabbricati dopo l’ordine/acquisto.
Sono accettati pagamenti con carta di credito, bonifico bancario e Paypal.
Il termine di spedizione è di 5 giorni lavorativi (Lunedì-Venerdì)dalla effettiva ricezione del pagamento.
Spediamo i prodotti esclusivamente tramite corriere espresso e forniamo il numero di tracciatura del pacco al cliente il giorno stesso della spedizione.
E' facoltà del cliente richiedere di assicurare la spedizione (per costi e condizioni si prega contattarci tramite email prima dell’acquisto)
GARANZIA PRODOTTI
La garanzia sui nostri prodotti rimane in vigore per 2 anni (1 anno se l’acquirente è una società) dalla data di acquisto. Al momento della richiesta di intervento garanzia è indispensabile fornire il documento comprovante la data di acquisto (fattura, ricevuta, ecc.) Si prega di averlo a disposizione al momento del contatto ..
Limitazioni di garanzia
La responsabilità dell’impresa Bagni Claudio è limitata alla riparazione o sostituzione, a nostra discrezione, di qualsiasi prodotto difettoso e non comprende i danni incidentali o consequenziali, pertanto le limitazioni di cui sopra potrebbero non essere applicabili. Questa garanzia non comprende:
1.i prodotti senza prova legittima di acquisto
2.prodotti le cui identificazioni o marcature sono state rimosse, alterate, cancellate o rese illeggibili
3.danneggiamenti causati da abuso o uso improprio, montaggio scorretto, manutenzione errata o insufficiente, gli incidenti, urti, la corrosione, l’uso di detergenti aggressivi, l’uso con componenti non compatibili, riparazioni improprie, e più in generale tutto ciò che non è un materiale o un difetto di fabbricazione.

Autorizzazione alla restituzione – Spedizioni
Prima di restituire un prodotto a Bagni Claudio, è necessario richiedere una formale autorizzazione. Il costo di spedizione alla sede di Bagni Claudio, sono a spese dei clienti.

I nostri articoli sono realizzati su misura e/o personalizzati e fabbricati all’ordine secondo le richieste del cliente; il reso e’ possibile solamente a fronte di difetti di fabbricazione ( DECRETO LEGISLATIVO 21 febbraio 2014, n. 21 – e in modo particolare per quanto disposto dall’ art. 59 lettera C del suddetto decreto.)
Il ritorno della merce deve essere preceduto da una email di richiesta ove saranno indicate le motivazioni della restituzione. Tale comunicazione dovra’ essere fatta preferibilmente entro entro 7 giorni dal ricevimento della merce, Si ricorda comunque che il termine legale per qualsiasi tipo di contestazione è di giorni 14 dalla data di ricevimento. in ogni caso farà fede la data di consegna. Si attenderà la nostra risposta scritta che validerà la richiesta.
Nel testo si deve spiegare quale/quali difetti sono stati riscontrati. Una volta ricevuto il prodotto, si verificherà il danno e il produttore deciderà se procedere al rimborso oppure alla sostituzione,

L’impresa Bagni Claudio, dopo aver controllato il reso, provvederà quindi a restituire entro 7 gg. l’importo versato al netto delle spese di trasporto sostenute o a rispedire il medesimo articolo in sostituzione, in tal caso il trasporto sarà a carico del venditore.
Si intende nuovamente informare il cliente che in ogni caso non saranno accettati resi in contrassegno o riferimenti a qualsiasi accordo verbale in contraddizione con le suindicate condizioni di vendita. In caso di controversie farà fede esclusivamente la corrispondenza scritta.
Per ogni controversia il foro competente sara’ quello di Verona.
INFORMATIVA SULLA PRIVACY ai sensi del D. Lgs. 196/2003, art 13
La scrivente impresa Bagni Claudio informa che, al fine dell’instaurazione e dell’esecuzione dei rapporti contrattuali, sarà in possesso di dati a Voi relativi, dati qualificati come personali dalla legge indicata in oggetto.
Con riferimento a tali dati Vi informiamo pertanto:
I dati verranno trattati con il supporto di mezzi cartacei ed informatici. Tutti i dati di cui all’oggetto, verranno conservati presso la sede di Verona, in Via Calderini 8, nel pieno rispetto della riservatezza, in ottemperanza a tutte le norme vigenti. I dati verranno conferiti soltanto per finalità amministrative e contabili. Il conferimento dei dati di cui al punto 2 è obbligatorio, e il mancato conferimento comporterà l’impossibilità dell’espletamento dei rapporti commerciali.
I suoi dati potranno essere comunicati esclusivamente ai soggetti competenti per l’espletamento dei servizi necessari ad una corretta gestione del rapporto di lavoro, con garanzia di tutela dei diritti dell’interessato. I suoi dati saranno trattati all’interno dell’ azienda dal Responsabile e dagli Incaricati e potranno essere comunicati all’esterno dell’azienda a categorie di soggetti di cui la scrivente si avvale per lo svolgimento della sua attività commerciale quali studi professionali, società di elaborazione dati contabili, società di consulenza, corrieri e spedizionieri, istituti di credito, società di recupero e tutela del credito.
La scrivente si premunirà di far garantire la massima riservatezza dai terzi sopra indicati e di far trattare i dati solo per le finalità di cui sopra.
Tutti i dati di cui all’oggetto verranno conservati anche dopo la cessazione del rapporto contrattuale, per l’espletamento di tutti gli adempimenti connessi o derivanti dalla conclusione del rapporto contrattuale stesso.
Titolare del trattamento dei dati conferiti e’ il titolare e legale rappresentante Sign.Claudio Bagni.
Responsabile del trattamento è la sign. Claudio Bagni, ai fini della legge nella sede stessa. Pertanto la S.V. potrà ad essa rivolgersi per tutte le informazioni riguardanti il trattamento dei suoi dati e per tutto quanto previsto nell’art. 7 D.Lgs. 196/03.
Vi ricordiamo che potrete opporVi in ogni momento al trattamento dei dati in oggetto mediante l’invio di telefax al nostro numero 0522.331656, nonché esercitare tutti i diritti di cui all’art. 7 del D.Lgs. 196/03, tra cui il diritto d’accesso, rettifica, aggiornamento e cancellazione.

Terms & Conditions
We accept payment at the orders, by bank transfer and Paypal.
Our shipping term is 7 days from the orders/payments.
We send the goods by express couriers and supply the tracking number to the customer by email, the same day of the shipment.
When you pay for the shipment, you are paying for the shipment untill your home, without other costs.
But If you are located in a country outside the EU (European Community), in many cases you will be contacted by the courier for the import taxes of your country and the courier commisions of Customs presentation.
For the satisfaction of our customers, we give a great quantities of variants of colour and materials, for this all our products are Custom made and cannot be returned for refund or credit.(Italian law about “conditions of sales and returns” please note, you can find the law as "DECRETO LEGISLATIVO 21 febbraio 2014, n. 21 – art. 59 letter C.)
In case of manufacturing defects or our error in processing the order, we will replace the product or repair it. The shipping cost to return to our location is customer's responsibility. Then we will pay the new shipping cost to the customer with the replaced product.
The item will be returned within 7 business days of customer receipt as per tracking records. Contact us before to return products and wait for our email / fax of authorization.
Limited Warranty
The warranty on our products remains in effect for 2 years (1 year if the buyer is a company) from the date of the first consumer purchase. Braccioli Italy Armrest protects the original owner: The original, dated bill of sale is required whenever warranty service is required. Please have this available before making contact.
Limitations of Warranties
Bagni Claudio company liability is limited to the repair or replacement at our option, of any defective product and shall not include incidental or consequential damages, so the above limitations and exclusions may not apply to you. This warranty does not cover:
1.products without a legitimate dated proof of purchase
2.products whose identification markings have been removed, altered, effaced or made unreadable
3.damage caused by abuse or misuse, improper assembly, improper or insufficient maintenance, accidents, impacts, corrosion, aggressive cleaners, use with non compatible components, improper repairs, and more generally anything which is not a material or manufacturing defect.
4.UV rays effects (colors fading)
5.the effects of saline environment
6.re-painted products (also partially)
7.products modified in any way
8.shipping damage (the forwarder is responsible)
Return Authorization – Shipments
If you need to return a product for defect, to Bagni Claudio company, you need before to request a formal Return Authorization.

Data controller and reference legislation
The Data Controller is Bagni Claudio Company - Via Calderini 8 - 37129 Verona - Italy; hereinafter "Bagni Claudio", for the sake of brevity.
Bagni Claudio processes personal data in compliance with the European legislation on the Protection of Personal Data (hereafter "GDPR", for the sake of brevity). Pursuant to articles 12, 13 and 14 of the GDPR, the Data Controller provides the present information on the processing of personal data carried out by it.
Purposes of the treatments without express consent
All personal information that you provide to us without express consent, via web or email or other, are optional and the result of your free choice. This information will only be processed by Bagni Claudio for the purposes of: (a) responding to your requests, (b) fulfilling our contractual obligations, (c) pursuing the legitimate interests of the Controller [example: defending itself in the legal], (d) fulfill legal and tax obligations.
Method of treatment
The data will be processed with the support of paper and electronic means. All data relating to the object will be stored at the Verona headquarters, Via Calderini 8, in full respect of confidentiality, in compliance with current regulations.

Bagni Claudio will retain personal data for the period necessary and sufficient for the purposes stated or required by legal and tax regulations or until the person requesting the cancellation (see also Rights of the interested party).
Rights of the interested party
The natural person to whom the data refers ("concerned"), has the following rights:
- revoke the Data Controller's consent at any time if there are no other legal bases that oblige the data to be maintained: for example, data necessary for the execution of our contractual or regulatory or tax obligations
- propose a complaint to the Supervisory Authority (Guarantor),

- ask the Data Controller to delete their personal data if there are no other legal bases that oblige the data to be kept: for example, data necessary for the execution of our contractual or regulatory or tax obligations
Categories of personal data
Unless otherwise provided freely by the interested party, Bagni Claudio only processes "common" personal data. The systematic and continuous treatment of "particular data" (ie: sensitive, medical, judicial, etc.) is excluded.
Sources of personal data
Bagni Claudio may receive your personal data from you for your free choice (via email, website, telephone, fax, etc.) or from public sources (public records, social networks, etc.).
